Welcome to Band in Your Hand, a service that creates personalised, AI-generated songs from the details you provide. By creating an account or using the app, you agree to these Terms of Use. You must be an adult (18 or older) to use the app and to make purchases. Many songs are made for children, but the app is intended to be used by grown-ups. You're responsible for activity that happens under your account.
Songs, lyrics and music are generated by artificial intelligence based on the names, descriptions and prompts you enter, using trusted third-party AI providers. Because the output is generated automatically, results vary and may not be exactly what you expect. We don't guarantee any particular result.
You agree not to use Band in Your Hand to create or share content that is unlawful, hateful, harassing, defamatory, sexually explicit, that sexualises or endangers minors, that infringes anyone's rights, or that impersonates a real person without their consent. We may remove content and suspend or terminate accounts that breach these terms. If you come across content you believe is objectionable, please report it to tegbers@gmail.com and we'll review it promptly.
The details you enter remain yours. Subject to these terms and your having paid any applicable fees, you may use the songs you create for personal, non-commercial purposes. You grant us the limited permission needed to generate, store and deliver your songs and to operate the service. You're responsible for ensuring you have the right to use any names or details you enter.
New accounts include a limited number of free songs. Beyond that, you can buy track packs (one-time purchases) or subscribe to a Studio Pass. Track credits and pass allowances are for use within the app and have no cash value.
Studio Pass is an auto-renewing monthly subscription. Payment is charged to your payment method (your Apple ID for in-app purchases on iOS, or our web payment partner) at the time of purchase, and it renews automatically each month unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time: on iOS, in your device Settings under your Apple ID subscriptions; on the web, via your account or by contacting us. Cancelling stops future renewals; the current period continues until it ends.
Purchases made through the App Store are processed by Apple and are subject to Apple's terms and refund policies; refund requests for those purchases are handled by Apple. Purchases made on the web are processed by our payment partner. Except where required by law, fees are non-refundable.
You can delete your account at any time from within the app (Account → Delete my account). Deleting your account permanently removes your account, your songs and your balance, except anything we're required to keep for legal or accounting reasons. Active subscriptions should be cancelled separately through the store that manages them.
The app is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or that generated songs will meet your expectations.
To the maximum extent permitted by law, Band in Your Hand and its operator are not liable for indirect, incidental or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law.
You agree to indemnify and hold harmless Band in Your Hand and its operator from any claims, damages, losses or expenses (including reasonable legal fees) arising out of your misuse of the app, your breach of these terms, or content you create or share in violation of these terms or any law or third-party right.
We may suspend or terminate your access to the app at any time if you breach these terms or use the app in a way that may cause harm to us, other users, or third parties. You may stop using the app and delete your account at any time.
If you have a concern, please contact us first at tegbers@gmail.com — most issues can be resolved quickly and informally. Any dispute that can't be resolved that way is subject to the laws of South Africa and the jurisdiction of its courts.
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the app. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms; we may assign ours in connection with a merger, acquisition or sale of assets. Headings are for convenience only.
We may update these terms from time to time. If we make significant changes, we'll update this page and, where appropriate, let you know in the app. Continuing to use the app after changes means you accept the updated terms.
These terms are governed by the laws of South Africa.
